Privacy Policy
This Privacy Policy describes the information GemiGuard receives about the User when the site is used, and how we process and protect it.
This Personal Data Privacy Policy (hereinafter — the Privacy Policy) applies to all information that the online store “gemiguard.com”, located at the domain name gemiguard.com, may obtain about the User while the User uses the online store’s site, programs and products.
Processing of personal data
1. Definition of terms
1.1. The following terms are used in this Privacy Policy:
1.1.1. “Administration of the online store’s site (hereinafter — the Site Administration)” — authorized site-management staff acting on behalf of gemiguard.com, who organize and/or carry out the processing of personal data and also determine the purposes of processing personal data, the composition of the personal data to be processed, and the actions (operations) performed with the personal data.
1.1.2. “Personal data” — any information relating directly or indirectly to an identified or identifiable natural person (the personal-data subject).
1.1.3. “Processing of personal data” — any action (operation) or set of actions (operations) performed with or without the use of automation tools on personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion and destruction of personal data.
1.1.4. “Confidentiality of personal data” — a requirement, mandatory for the Operator or any other person who has obtained access to personal data, not to allow their distribution without the consent of the personal-data subject or another lawful basis.
1.1.5. “User of the online store’s site (hereinafter — the User)” — a person who accesses the Site via the Internet and uses the online store’s Site.
1.1.6. “Cookies” — a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server each time in an HTTP request when trying to open a page of the corresponding site.
1.1.7. “IP address” — a unique network address of a node in a computer network built on the IP protocol.
2. General provisions
2.1. The User’s use of the online store’s site signifies consent to this Privacy Policy and to the terms of processing the User’s personal data.
2.2. If the User disagrees with the terms of the Privacy Policy, the User must stop using the online store’s site.
2.3. This Privacy Policy applies only to the online store’s site gemiguard.com. The online store does not control and is not responsible for third-party sites the User may follow via links available on the online store’s site.
2.4. The Site Administration does not verify the accuracy of the personal data provided by the User of the online store’s site.
3. Subject of the Privacy Policy
3.1. This Privacy Policy establishes the Site Administration’s obligations regarding non-disclosure and the protection of the confidentiality of the personal data that the User must, on request, provide to the Site Administration when registering on the online store’s site or when placing an order to purchase a Product.
3.2. The personal data permitted for processing under this Privacy Policy is provided by the User by completing forms on the online store’s Site gemiguard.com and includes the following information:
- the User’s surname, first name and patronymic;
- the User’s contact phone number;
- email address;
- the Product delivery address;
- the User’s place of residence.
3.3. The online store protects the data automatically transmitted while the site’s pages are viewed:
- IP address;
- information from cookies;
- browser information;
- access time;
- the address of the page being opened;
- the referrer (address of the previous page).
3.3.1. Disabling cookies may make it impossible to access parts of the online store’s site that require authorization.
3.3.2. The online store collects statistics on the IP addresses of its visitors. This information is used to detect and resolve technical problems and to monitor the lawfulness of financial payments made.
4. Purposes of collecting the User’s personal information
4.1. The Site Administration of the online store may use the User’s personal data for the purposes of:
- identifying the User to place an order and/or conclude a distance sale-and-purchase contract with gemiguard.com;
- providing the User with access to personalized resources of the online store’s Site;
- establishing feedback with the User, including sending messages and requests regarding the use of the Site, the provision of services, and the processing of the User’s requests and applications;
- determining the User’s location to ensure security and prevent fraud;
- confirming the accuracy and completeness of the personal data provided by the User;
- creating an account for making purchases, if the User has consented to its creation;
- notifying the User of the online store’s Site about the status of the Order;
- processing and receiving payments, and handling payment disputes;
- providing the User with effective customer and technical support in the event of problems related to the use of the online store’s Site;
- providing the User, with their consent, with product updates, special offers, price information, newsletters and other information on behalf of the online store;
- carrying out advertising activities with the User’s consent.
5. Methods and terms of processing personal information
5.1. Processing of the User’s personal data is carried out by any lawful means, including in personal-data information systems with or without the use of automation tools, for the period necessary to achieve the purposes of the processing.
5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties — in particular courier services, postal organizations and telecommunications operators — solely for the purpose of fulfilling the User’s order placed on the online store’s Site “gemiguard.com”, including delivery of the Product.
5.3. The User’s personal data may be transferred to authorized state authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.
5.4. In the event of loss or disclosure of personal data, the Site Administration informs the User of the loss or disclosure of the personal data.
5.5. The Site Administration takes the necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, and other unlawful actions by third parties.
5.6. Together with the User, the Site Administration takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
6. Obligations of the parties
6.1. The User is obliged to provide the personal-data information required to use the online store’s Site, and to update or supplement the information provided if it changes.
6.2. The Site Administration is obliged to use the information received solely for the purposes specified in Section 4 of this Privacy Policy, to keep confidential information secret, not to disclose it without the User’s prior written consent, and to take precautions to protect the confidentiality of the User’s personal data.
7. Liability of the parties
7.1. A Site Administration that has failed to fulfil its obligations is liable for the losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of Ukraine, except in the cases provided for by this Privacy Policy.
7.2. In the event of loss or disclosure of confidential information, the Site Administration is not liable if that confidential information became public before its loss or disclosure, was received from a third party before it was obtained by the Site Administration, or was disclosed with the User’s consent.
8. Dispute resolution
8.1. Before filing a lawsuit in disputes arising from the relationship between the User of the online store’s site and the Site Administration, it is mandatory to submit a claim (a written proposal for the voluntary settlement of the dispute).
8.2. Within 30 calendar days of receiving the claim, the recipient of the claim notifies the claimant in writing of the results of its consideration.
8.3. If no agreement is reached, the dispute will be referred to a judicial authority in accordance with the current legislation of Ukraine.
8.4. The current legislation of Ukraine applies to this Privacy Policy and to the relationship between the User and the Site Administration.
9. Additional terms
9.1. The Site Administration has the right to make changes to this Privacy Policy without the User’s consent.
9.2. The new Privacy Policy takes effect from the moment it is posted on the online store’s Site, unless otherwise provided by the new version of the Privacy Policy.
